Q.: After I file BK, can I buy a car or a home?
A.: Yes, there is nothing in the law that disqualifies you or prevents you from purchasing a new car or home after a bankruptcy. In fact, many finance companies and mortgage companies have special programs for individuals who have been through a bankruptcy.

Q.: How does filing affect my credit score?
A.: The bankruptcy can actually help your credit score. In most cases credit scores actually raises an average of 83 points within a year after the bankruptcy.

Q.: Will I lose my house or my car?
A.: So long as you’re up-to-date on the payments you will not lose your home or your car. The finance companies would be more than happy for you to keep paying on it in for you to keep the asset rather than to take it from you.

Q.: Will I lose my job?
A.: No. By law you cannot be discriminated against in your employment or lose your job because you filed a bankruptcy.

Q.: I have 5 credit cards, but I would like to keep 1. Is that possible?
A.: It is up to the credit card company whether or not they will allow you to keep one of their credit cards. In most cases, most of our clients get preapproved credit cards after they receive their bankruptcy discharge. The reason being is after the bankruptcy your debt is wiped out and in most cases your credit score rises. Creditors see that you have no other debts to pay which makes you a better credit risk for them.

Q.: Can I file on BK the money I owe on child support?
A.: No. By law the support obligations are not dischargeable.

Q.: What is the difference between a Chapter 7 and a Chapter 13?
A.: A chapter 7 bankruptcy discharges your debt. A chapter 13 bankruptcy will also discharge of debt but requires that you pay a percentage of your existing debt over a three to five-year period. The amount that it does not pay is discharged as if it were a chapter 7. You must show that you qualify for a Chapter 7. A chapter 13 will also allow you to save your home if you are behind on payments on the mortgage.

Q.: Can I request a new credit card after I file BK?

Q.: Will my bankruptcy be published in the newspaper?
A.: No. newspapers do not publish bankruptcy filings for individuals.

Q.: Can a creditor call me after I file BK?
A.: From the time that the bankruptcy is filed a creditor cannot contact you for collection of the debt. The law provides serious consequences against them if you are requested to pay a discharge debt.

Q.: I own two or more properties; do I have to surrender them? All of them?
A.: No, law allows you to keep one or more properties that you own.

Q.: I currently rent, does my landlord need to know I’m filing BK?
A.: No.

Q.: Can I file the money I owe to the IRS on my BK?
A.: Generally, if the taxes you owe are three years old or older they are dischargeable in a bankruptcy.

Q.: I currently collect SS / SSD / 401K / other form of retirement, are the creditors going to keep the money I collect?
A.: By law, Social Security and pension that has been built up is protected in a bankruptcy.
